1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and AccessibilityWidg ("Company," "we," "us," or "our") concerning your access to and use of the AccessibilityWidg website accessibility widget service ("Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

AccessibilityWidg provides a web accessibility widget that can be embedded on websites to provide accessibility features to end users. The Service includes:

  • JavaScript widget for web accessibility features (21 features, 7 disability profiles)
  • Dashboard for managing domains and viewing analytics
  • Analytics tracking of accessibility feature usage
  • Domain verification and management
  • Token-based usage billing system
  • Customization options for widget appearance

3. User Accounts

3.1 Account Creation

To use the Service, you must:

  • Create an account with accurate and complete information
  • Be at least 18 years old or the age of majority in your jurisdiction
  • Have the authority to enter into this agreement
  • Maintain the security of your account credentials

3.2 Account Responsibility

You are responsible for:

  • All activities that occur under your account
  • Maintaining the confidentiality of your password
  • Notifying us immediately of any unauthorized access
  • Ensuring your account information is accurate and up-to-date

4. Subscription Plans and Billing

4.1 Free Trial

New accounts receive 100 free tokens upon signup. Free tokens are provided as-is with no guarantees of service level or support.

4.2 Paid Plans

We offer the following subscription tiers:

  • Basic: $19/month - 2,500 tokens/month, 1 domain
  • Pro: $49/month - 10,000 tokens/month, 5 domains
  • Business: $149/month - 50,000 tokens/month, unlimited domains
  • Enterprise: Custom pricing - Unlimited tokens, unlimited domains

4.3 Token Usage

Tokens are consumed based on widget usage events (feature activations, profile changes, panel opens). Each user interaction counts as 1 token. Unused tokens do not roll over to the next billing period.

4.4 Payment Terms

  • All fees are in USD and exclude applicable taxes
  • Subscriptions are billed monthly or annually in advance
  • Payment is processed through Stripe
  • Failed payments may result in service suspension
  • No refunds for partial months or unused tokens

4.5 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of the paid period.

5. Domain Verification and Usage

You may only use the Service on domains that you own or have permission to modify. Domain verification is required before the widget will function. You agree to:

  • Only add domains you have authority to use
  • Complete the verification process (DNS TXT record or HTML file)
  • Not exceed the domain limit for your subscription tier
  • Remove the widget if you lose control of a verified domain

6. Acceptable Use Policy

You agree NOT to:

  • Use the Service for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction
  • Infringe intellectual property rights
  • Transmit viruses, malware, or harmful code
  • Attempt to bypass token limits or authentication
  • Reverse engineer, decompile, or disassemble the Service
  • Use the Service to harm, harass, or discriminate against others
  • Interfere with or disrupt the Service or servers
  • Create multiple accounts to abuse free trials
  • Resell or redistribute the Service without authorization
  • Remove or modify any copyright or proprietary notices

7. Data Collection and Analytics

By using the Service, you acknowledge and agree that we collect analytics data from end users who interact with the accessibility widget on your website. This data includes:

  • Feature usage events (which accessibility features are used)
  • Device and browser information
  • Page URLs and referrers
  • Session data (anonymized)
  • Technical information (screen size, language, timezone)

We do NOT collect personally identifiable information (PII) from end users. You are responsible for ensuring your privacy policy discloses the use of third-party accessibility tools that collect analytics.

8. Intellectual Property

8.1 Our Rights

The Service, including all code, designs, graphics, and content, is owned by AccessibilityWidg and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service according to these Terms.

8.2 Your Rights

You retain all rights to your website content and data. By using the Service, you grant us a license to collect and process analytics data as described in our Privacy Policy.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties of non-infringement
  • Warranties that the Service will be uninterrupted or error-free
  • Warranties regarding the accuracy or reliability of data
  • Warranties of full WCAG 2.1 AA/AAA compliance

While we strive to provide accessibility features that help meet WCAG guidelines, we do not guarantee complete compliance with any accessibility standards. You are responsible for ensuring your website meets applicable accessibility requirements.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACCESSIBILITYWIDG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or goodwill
  • Service interruptions
  • Cost of substitute services
  • Business interruption
  • Legal claims arising from accessibility compliance

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless AccessibilityWidg from any claims, damages, losses, liabilities, and expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Accessibility compliance claims related to your website
  • Unauthorized use of your account

12. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted availability. We may suspend or terminate the Service for:

  • Scheduled maintenance (with notice when possible)
  • Emergency maintenance or security issues
  • Violation of these Terms
  • Non-payment
  • Illegal activity or abuse

13. Termination

13.1 By You

You may terminate your account at any time by contacting support or using the account deletion feature.

13.2 By Us

We may suspend or terminate your account immediately if you:

  • Violate these Terms
  • Fail to pay fees when due
  • Engage in fraudulent or illegal activity
  • Abuse the Service or harm other users

13.3 Effect of Termination

Upon termination:

  • Your access to the Service will immediately cease
  • The widget will stop functioning on your domains
  • You lose access to your analytics data after 30 days
  • No refunds will be provided for unused tokens or partial periods

14. Modifications to Service and Terms

We reserve the right to modify or discontinue the Service, or to modify these Terms, at any time. We will provide notice of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. The governing jurisdiction will be determined based on your location and our business operations.

Any disputes arising from these Terms or the Service should first be resolved through good-faith negotiation. If resolution cannot be reached, disputes may be subject to binding arbitration or legal proceedings in accordance with applicable laws in the relevant jurisdiction.

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AccessibilityWidg.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision shall not constitute a waiver of that right or provision.

16.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms at any time.
